Recounting Impunity: A statement of the Union of Journalists of the Philippines-UP Diliman

by Ujp-up Diliman on Friday, November 18, 2011 at 8:59am
In a matter of days, we will once again be commemorating the anniversary of what has been dubbed the “single deadliest attack on journalists in recent history.” The Maguindanao Massacre took the lives of 58 people, 32 of whom journalists accompanying the Mangundadatus in filing the gubernatorial certificate of candidacy for Esmael Mangudadatu.
It is to no surprise that such blatant acts against free expression and truth send a “chilling-effect” to the media. In a system where the ruling elite control political affairs, journalists only find their freedom suppressed as they trepidate on the controversial issues concerning the most powerful personalities in the country.
To counter such hard-hitting reportage of journalists, the ruling class has perpetuated a culture of impunity – killing journalists to silence a story. Critical reportage may then be interpreted as an attempt to challenge the existing status quo.
Indeed, the Maguindanao Massacre has served as a venue for journalists to find a common cause against an unjust system, arming themselves not with ammunitions, but with the power of the pen.
Trial Updates
As trials continue, currently only 93 of 196 total suspects, accused to have participated in the gruesome murders, have been detained.
Meanwhile, in a 4-1 decision by the 11th Division of the Court Appeals, CA junked suspended ARMM Governor Zaldy Ampatuan’s plea to strike his name off the 196 name-list of individuals charged with the multiple murder case. Nena Santos, private prosecutor for the Magundadatus, said the ruling retaining him as a suspect was a “very welcome news.”
On the other hand, Harry Roque, lawyer for the victims’ families, called the ruling “bittersweet”, as he suspects that Zaldy had already foreseen the possible outcome as he plans to enter the Witness Protection Program by the Department of Justice instead.
Getting Away with Murder
Zaldy, in an exclusive interview with ABS-CBN, expressed his intentions of “spilling the beans” including his knowledge of the alleged electoral fraud in the 2004 and 2007 elections.
Legal experts including Freedom Fund for Filipino Journalists legal counsel Prima Jesusa Quinsayas said in a statement that in the event that the Malacanang endorses Zaldy into the Witness Protection Program, the 57 counts of murder charged against him cannot be dropped, as the case of the massacre and electoral fraud were separate in nature.
Justice Secretary Leila de Lima on the other hand had earlier stated that Zaldy would not qualify as a state witness on the grounds that he has kept his innocence, thus disqualifying him. A state witness has to admit guilt and must be one of the least guilty among the accused.
November 23 as International Day to End Impunity
The Maguindanao Massacre has received much attention from local and international media organizations and human rights advocates.
Toronto-based International Freedom of Expression Exchange (IFEX), together with their network of 95 member organizations around the world, announced June 2 this year their decision to join forces to globally put an end to journalist killings, making November 23 the “International Day to End Impunity.”
The decision came as a result of IFEX receiving word of the abduction and murder of Pakistani investigative journalist Saleem Shahzad. A day later, the conference buzzed with news of an arrest more than five years after the murder of iconic Russian journalist Anna Politkovskaya.
Breaking away from old ideas
As an organization upholding a pro-masses, pro-student stance on issues, the Union of Journalists of the Philippines – UP demand immediate justice be given to the victims of the Maguindanao Massacre.
We reiterate our stance to the right of the families of the victims to a speedy trial and resolution of the case.
Zaldy’s decision to become a state witness for the case is nothing but a desperate move to save himself from prosecution and conviction.
We hold that press freedom – the right to the reportage of the truth, and the right to dissent and be critical of officials to hold them accountable – is a must: a pre-requisite for any working democracy. In a society that has long privileged and permitted influential clans, landlords, big business, and warlords to get away with every perceivable plunder, murder and theft, our current democracy is not the democracy of the majority. It is nothing but a democracy for the ruling elite.
This is not the time for neutrality. This is not the time to be docile and passive.
This is the time to make a stand, to destroy the ivory tower that masks itself with the myth of “objectivity” which separates the journalist from the society, its subject. Today, we are the subject.
STOP THE KILLINGS!
END IMPUNITY!
JUSTICE FOR THE VICTIMS OF THE MAGUINDANAO MASSACRE!

Bukas Na Liham sa Lahat ng Iskolar ng Bayan from STAND-UP
Dear Isko/Iska:
Welcome back sa Pamantasan!
Kamusta ang pagbabalik klase? Nahirapan ka bang mag-enroll? Ang daming ineligible no?
Kaya nga naglunsad tayo ng strike last sem diba?
